On May 1, 2009, Thornburg Mortgage, Inc. filed for Chapter 11 bankruptcy protection to commence an orderly sale and liquidation of our remaining assets in order to maximize any remaining value for our bondholders and creditors. Once these sales and liquidations are completed, we will discontinue operations.
On August 7, 2009, the name of the company was changed from Thornburg Mortgage, Inc. to TMST, Inc. This name change does not affect the bankruptcy proceedings, outstanding debt and equity of Thornburg Mortgage or loans owned and/or serviced by Thornburg Mortgage.

We do not expect to file our Annual Report on Form 10-K for the year ended December 31, 2008. As a result of not filing of our 10-K, we are not "current" in our public information for purposes of Rule 144.
